Terms and Conditions of Use

This is a courtesy translation. The legally binding version of this document is the Spanish one; in case of any discrepancy, the Spanish version prevails.

1. Acceptance of the terms

Welcome to GamGam. These Terms and Conditions (the "Terms") govern access to and use of the GamGam mobile application (the "App"), operated by Daokio, identified with NIT 1016036611, domiciled at Cr 134 # 17 - 37, Bogotá, Colombia (hereinafter, "GamGam", "we").

By creating an account or using the App, you (the "User") declare that you have read, understood and accepted these Terms and the Personal Data Processing Policy. If you do not agree, you must not use the App.

2. Description of the service

GamGam is a platform that allows its users to:

Discover events near their location and view information about them, including the number of attendees.
Create and manage their own events (the "Organizers").
Interact with other attendees of the same event through games, direct chat and group chats managed by the Organizer.
Establish connections ("matches") with other users when there is mutual interest.

GamGam is a technological intermediation platform. GamGam does not organize, operate, promote or supervise the events published by Organizers, and is not responsible for their occurrence, quality, safety, legality or cancellation.

3. Age requirements

The App is directed exclusively to persons over 18 years of age. Upon registering, the User declares under oath that they are of legal age. GamGam may suspend or delete accounts when there are reasonable indications that they belong to minors.

4. User account

4.1. To use the App, the User must create an account with truthful, complete and up-to-date information.

4.2. The User is responsible for keeping their credentials confidential and for all activity carried out from their account.

4.3. It is prohibited to create fake accounts, impersonate others, or create more than one account per person.

4.4. GamGam may suspend or cancel accounts that breach these Terms.

5. Rules of conduct

When using the App, the User agrees NOT to:

Harass, intimidate, threaten or discriminate against other users.
Publish illegal, violent, sexually explicit or defamatory content, or content that infringes third-party rights.
Use the App for unauthorized commercial purposes, spam or fraudulent schemes.
Contact other users for purposes other than the App's own social interaction when they have expressed that they do not wish to be contacted.
Collect data from other users by any means.
Interfere with the technical operation of the App.

Breach of these rules may result in the suspension or deletion of the account, without prejudice to any legal actions that may apply.

6. User-generated content

6.1. Users may publish content in the App: profile photos, messages, event photos and videos (the "User Content").

6.2. The User retains ownership of their Content, but grants GamGam a non-exclusive, free, worldwide license, for the term of legal protection, to host, reproduce, adapt and publicly communicate such content within the App and in GamGam's promotional materials, solely in connection with the operation and promotion of the service.

6.3. By uploading event photos or videos, the User declares that they have the necessary authorizations of the persons appearing in them.

6.4. Any person appearing in content published by another user may request its removal through support@gamgam.app. GamGam will handle these requests as a priority.

6.5. GamGam may moderate, hide or remove User Content that breaches these Terms, without this implying an obligation of prior supervision of all content.

7. Events and organizers

7.1. Organizers are solely responsible for the information published about their events, as well as for their occurrence, permits, logistics and safety.

7.2. Organizers who manage group chats agree to moderate them reasonably and not to use them for purposes other than the event.

7.3. Attendance at events is at the User's own risk. GamGam recommends taking reasonable precautions when attending events and when meeting people met through the App.

7.4. The attendance and concentration data shown in the App are estimates based on available information and do not constitute a guarantee.

8. Personal safety

GamGam facilitates interactions between people who do not know each other. The User acknowledges that GamGam does not verify users' backgrounds. It is recommended to: meet in public places, inform trusted persons, and immediately report any inappropriate conduct through the option to report a user within the App or support@gamgam.app.

9. Intellectual property

The App, its name, logo, design, code and features are the property of Daokio or its licensors, and are protected by intellectual property regulations. Nothing in these Terms grants the User any rights over them.

10. Payment services (reserved)

Currently, use of the App is free for attendees. GamGam may introduce paid features in the future, in which case it will inform their conditions in advance.

11. Limitation of liability

To the maximum extent permitted by Colombian law, GamGam will not be liable for: damages arising from the conduct of other users or Organizers within or outside the App; the cancellation or quality of events; service interruptions; or data loss for causes beyond GamGam's control. Nothing in this clause limits liabilities that by law cannot be excluded, including those arising from the Consumer Statute (Law 1480 of 2011) where applicable.

12. Termination

The User may delete their account at any time from the App. GamGam may suspend or terminate accounts for breach of these Terms. After deletion, data will be handled in accordance with the Data Processing Policy.

13. Modifications

GamGam may modify these Terms. Substantial changes will be notified within the App with reasonable advance notice. Continued use after notification constitutes acceptance.

14. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Colombia. Any dispute will be resolved before the competent courts of Bogotá, without prejudice to the consumer's right to appeal to the Superintendence of Industry and Commerce.
